Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Date Cards website (getdatecards.com), the Date Cards mobile application, and all related services (collectively, the "Service"), operated by Date Cards, Brussels, Belgium.

By accessing the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

You must be at least 18 years old to use Date Cards. By creating an account or joining the waitlist, you confirm that you are 18 or older and legally capable of entering into a binding agreement.

Date Cards is not available to persons previously removed from the Service for violations of these Terms, or to persons located in jurisdictions where the Service is not permitted by law.

Subject to your compliance with these Terms, Date Cards grants you a limited, non-exclusive, non-transferable, revocable licence to download, install, and use the Date Cards app on devices you own or control, for your personal, non-commercial use only.

You may not:

• Copy, modify, or distribute the app or its content
• Reverse-engineer, decompile, or attempt to extract the source code
• Use the app for any commercial purpose without our written consent
• Sub-license or sell access to the Service

All content, features, and functionality of the Service — including but not limited to the name "Date Cards," the envelope logo, design, text, graphics, and code — are the exclusive property of Date Cards and are protected by copyright, trademark, and other applicable laws.

You retain ownership of content you submit (profile photos, messages). By submitting content, you grant Date Cards a limited, non-exclusive licence to display and store that content solely for the purpose of operating the Service.

You agree not to use the Service to:

• Harass, abuse, threaten, or intimidate other users
• Post false, misleading, or fraudulent information
• Impersonate another person or entity
• Solicit money, promote escort services, or engage in any commercial solicitation
• Distribute spam, malware, or unsolicited messages
• Scrape, crawl, or otherwise systematically extract data from the Service
• Circumvent, disable, or interfere with security features of the Service
• Use automated bots, scripts, or other tools to interact with the Service
• Post content that is illegal, obscene, defamatory, or violates the rights of others

Violation of these rules may result in immediate account suspension or termination, at our sole discretion.

The Date Cards waitlist lets you pre-register and refer friends in exchange for launch-day credits.

• Joining the waitlist does not create an account, guarantee access, or involve any payment
• Credits have no monetary value and cannot be transferred, sold, or redeemed for cash
• Credits obtained through abuse, fake accounts, or manipulation will be voided
• We reserve the right to modify or cancel the referral program at any time with notice

You may delete your account or leave the waitlist at any time by contacting hello@getdatecards.com.

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms, pose a risk to other users, or for any other reason at our sole discretion. Upon termination, your licence to use the app ceases immediately.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that the Service will be uninterrupted, error-free, or free of viruses. We make no warranties about the accuracy, reliability, or quality of content posted by users.

Date Cards is a platform for meeting people. We do not conduct criminal background checks and make no representations about the character or intentions of users. Your safety is your responsibility — please exercise caution.

To the maximum extent permitted by applicable law, Date Cards and its officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising from your use of or inability to use the Service.

Our total liability to you for any claim arising from these Terms or the Service shall not exceed the greater of €50 or the amount you paid to Date Cards in the 12 months preceding the claim.

Some jurisdictions do not allow limitation of liability for certain damages, so the above may not apply to you in full.

If you downloaded Date Cards from the Apple App Store, you acknowledge that:

• These Terms are between you and Date Cards only — not with Apple Inc.
• Apple has no obligation to provide maintenance or support for the app
• Apple is not responsible for any claims related to the app
• Apple is a third-party beneficiary of these Terms and may enforce them against you

If you downloaded Date Cards from Google Play, you acknowledge that Google Inc. is not a party to these Terms and bears no responsibility for the app or its content.

These Terms are governed by and construed in accordance with the laws of Belgium, without regard to conflict-of-law principles. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Brussels, Belgium.

If you are a consumer in the European Union, you also have the right to refer disputes to your local consumer protection authority or an EU online dispute resolution platform at ec.europa.eu/consumers/odr.
